Cancellation of Removal

If you have been ordered deported, and you are not a permanent residence, you may be eligible to remain lawfully in the United States through a process called cancellation of removal. To establish your eligibility for cancellation of removal, you:

  • Must have resided in the United States for at least 10 years
  • Must have been a personal of good moral character during your time in the US
  • Are not otherwise subject to criminal bars due to certain crimes
  • Must establish that your removal from the US would result in exceptional and extremely unusual hardship to your U.S. Citizen or permanent residence spouse, parent, or child.
